Acceptance of Terms
By downloading, installing, or using The Guessy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Description of Service
The Guessy is a trivia game generated from chat conversations you choose to import. You export a conversation from a messaging app such as WhatsApp, import it into the App, and the App builds quiz questions from the messages, timestamps, and statistics in that conversation.
Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian.
Pricing
The App may offer optional paid features. Any purchases are billed through Apple's App Store and managed through your Apple ID account settings.
Imported Conversations
Conversations you import contain messages written by you and by other people. You are responsible for ensuring you have the right to import a conversation, and we encourage you to play with the other participant, not about them. You agree not to use the App to harass, embarrass, or harm another person. Imported data is processed as described in our Privacy Policy.
Third Party Platforms
The App is not affiliated with, endorsed by, or sponsored by WhatsApp LLC, Meta Platforms, Inc., or Apple Inc. WhatsApp is a trademark of WhatsApp LLC. The App reads only chat export files that you create and share with it through your device's standard export and share features.
Apple App Store Terms
These Terms are between you and Luki Centuri only, not with Apple Inc., and Luki Centuri alone is responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance or support services for the App; support requests should go to rosarylock@pm.me. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the App; should the App fail to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price paid for it, and Apple will have no other warranty obligation of any kind. Luki Centuri is responsible for addressing any claims relating to the App, including product liability, any failure to conform to legal or regulatory requirements, claims arising under consumer protection or similar legislation, and any third party claim that the App infringes that party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with any applicable third party terms of agreement when using the App. Apple and its subsidiaries are third party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third party beneficiary.
Game Content
Questions, statistics, and labels generated by the App are produced automatically from your imported conversation, in part using automated language analysis. They are for entertainment purposes only and may contain errors or mislabelings. They are not a factual record or a judgment about any person or relationship.
Intellectual Property
All content, design, code, and branding of The Guessy are the property of Luki Centuri. You may not copy, modify, distribute, or reverse engineer any part of the App, except to the extent that applicable law expressly permits it notwithstanding this restriction. You retain all rights to your own conversation content.
Disclaimer of Warranties
The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, that the App will be error free, or that chat parsing and question generation will function perfectly for every conversation.
Limitation of Liability
To the maximum extent permitted by law, Luki Centuri shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Nothing in these Terms deprives you of the protection of any mandatory consumer law of the country in which you reside.
